2015 MCF AGM, KLCA's Status!

( 2015 MCF AGM - KLCA Status ) 

Dear KLCA Members & the Kuala Lumpur Chess Community,

(1) 22 September 2015
On 22nd September 2015, KLCA received from MCF a Notice via email dated 21st September 2015. The email  was addressed to KLCA's Honorary Secretary(HS).
The MCF email states the Date, Time and Venue for the 2015 MCF AGM.

Note: An addendum, was sent on 25 September 2015.

(2) In the same Notice, it was stated that KLCA (along with 4 other State Associations) have been barred from attending the AGM due to:-
 " Memandangkan negeri-negeri berikut gagal membayar yuran tahunan seperti yang dinyatakan dalam MCF Constitution Article 7 ( 7.2 ) tersebut diatas, maka negeri-negeri berikut tidak layak
untuk menghantar delegasi serta mengundi ataupun di undi semasa AGM. 

Walaubagaimanapun negeri-negeri yang tersebut boleh menghantar 2 wakil sebagai Pemerhati."

(3) KLCA disputes the official reason given by MCF.
Many reasons can be offered by KLCA. 2 of it are as follows:-
A. MCF owes KLCA money.
The amount owing to KLCA is for KLCA helping to pay MCF's FIDE arrears in 2013.
The amount owing by MCF to FIDE was in EURO currency.
Amount paid by KLCA to FIDE is more than enough to pay for at least 20 years(if not more) of the yearly Annual Fees.

B. KLCA had written many times to MCF querying the amount to be paid and how it is to be paid.
The email sent is under the title;-
"Query on PAYMENT of YEARLY FEES by KLCA to MCF "
and was copied to Most (if not All) of the MCF EXCO Members that KLCA is aware of.

To-date, MCF have NOT replied to this email nor sent any invoice for the Yearly fees to be paid. 
MCF have however found the time to invoice KLCA for 'alleged' ratings arrears. 


(4) 26 September 2015
KLCA via its HS had written an email dated 26th September 2015 titled
PERMOHONAN KLCA UNTUK SEMAKAN TERHADAP KEPUTUSAN MCF TIDAK MEMBENARKAN KLCA MENGAMBIL BAHAGIAN(MENCALONKAN & MENGUNDI) DALAM MESYUARAT AGUNG TAHUNAN PERSEKUTUAN CATUR MALAYSIA(MCF0 2015) ".
As at time of this post, NO official black and white reply have been received by KLCA from MCF.

(5) On the 22nd, 28th and 29th of  September 2015,
KLCA have filed a report/complaint with the pertinent authority(ies).

(6) 3 October 2015
As at this moment, KLCA takes the position that for the sake of all stakeholders of chess, matters should and can be resolved amicably.
However, subject to further advice from the pertinent authority(ies) and upon Checking the Prevailing Statute(s), Any Administrative and/or Legal Option(s) available to KLCA is on the table.
